Conducting Market Intelligence to Strengthen IP and Trademark Protection for a Pharmaceutical Company

Our client, a top pharmaceutical company, aimed to provide evidence that one of its products is widely recognized in the press as the “little blue pill” associated with erectile dysfunction.

The objective was to strengthen intellectual property and trademark protection, particularly in markets where the product may be reclassified from prescription-only to over-the-counter (OTC) status, helping to prevent competitors from adopting a similar tablet color and concept design.

Solution

A three-year social listening and online press review was conducted across consumer and pharmacy trade publications in relevant markets to identify content where the brand name, the “little blue pill” concept, and erectile dysfunction treatment were mentioned together.

From the most relevant material, 30 representative examples were selected to illustrate the strong association between the blue tablet concept and the brand across different media formats, including articles, blogs, audio and presentation-based content. Particular attention was given to synonymous expressions such as “little blue pill”, “blue tablet”, or “blue pill”, as well as references highlighting the tablet’s color as a distinctive brand attribute.

The analysis confirmed that the client’s erectile dysfunction product is widely recognized in press publications as the “little blue pill”.

Most reviewed articles associated the brand with blue tablet imagery, even in cases where the pill shown in the article did not contain a visible brand name, reinforcing the strength of the color-based brand recognition.

The research also found that the terms “blue pill” and “blue tablet” were commonly used as direct references to the brand across multiple media formats, including newspapers, online portals, industry publications, and lifestyle content.

The findings demonstrated that the color and concept association between the brand and the blue pill format is highly established in the public discourse, supporting trademark and intellectual property protection efforts in potential OTC markets.
